This paper’s purpose is to provide a foundation for viewing critical thinking as both a maximal and typical performance construct. While maximal performance measures the best a person can do, typical performance measures what the person is most likely to do. An overview of maximal performance, including its history and limitations, will be given. The role of maximal and typical performance in cognitive development will be demonstrated through an exploration of the relationships between behavior, the environment, personality, crystallized intelligence, and (...) fluid intelligence. Furthermore, these topics will be related to the development and use of critical thinking skills. Discussion will conclude with directions for future research. (shrink)

Stephen Cox writes of the complexities that guided this well-known columnist, literary critic, best-selling novelist, avid reader, and intellectual, Mary Isabel Bowler Patterson, better known as Isabel Paterson or “I.M.P.” This edited collection includes a well-chosen selection of her essays, reviews, and letters. Combining both formal and colloquial prose, Paterson’s writings incorporated quips about such people as Sinclair Lewis and Henry David Thoreau, as well as candid discussions of William F. A discussion of the general presuppositions and ideas which underlie the Christian ethical teaching, treating of such subjects as conscience, the concepts of sin and virtue, and the relation between morality and religion. The book also attempts to explain the traditional Christian attitudes towards certain particular matters of conduct; for example, marriage and divorce, gambling, and the rights and duties of private property. Written by the then Bishop of Exeter, this book was originally published in 1950.

The Altdeutsche Textbibliothek [Old German Text Library] is the series of editions of German medieval texts with the richest history. Foundedin 1881 by Hermann Paul, it has been edited by leading Germanists- Georg Beasecke, Hugo Kuhn, Burghart Wachinger. Since 2001, responsibility for the series has rested with Christian Kiening. In the meantime, the series comprises some 120 volumes, with an exemplary combination of closeness to the original manuscript(s) with ease of reading, philological accuracy with concern for university teaching. It includes (...) recognised editions of "classical" authors from around 1200- some with commentary- but also presents veritable editions of authors' works (Notker the German) and high-quality new editions (Eckenlied, Heinrich von dem Türlin). Ronald Dworkin famously argued that legal positivism is a defective account of law because it has no account of Theoretical Disagreement. In this article I argue that legal positivism—as advanced by H.L.A. Hart—does not need an account of Theoretical Disagreement. Legal positivism does, however, need a plausible account of interpretation in law. I provide such an account in this article.

Intersectional feminist scholars emphasize how overlapping systems of oppression structure gender inequality, but in focusing on the gendered, classed, and racialized bases of stratification, many often overlook disability as an important social category in determining economic outcomes. This is a significant omission given that disability severely limits opportunities and contributes to cumulative disadvantage. We draw from feminist disability and intersectional theories to account for how disability intersects with gender, race, and education to produce economic insecurity. The findings from our analyses (...) of 2015 American Community Survey data provide strong empirical support for hierarchies of disadvantage, where women and racial minority groups with disabilities and less education experience the highest poverty levels, report the lowest total income, and have a greater reliance on sources outside the labor market for economic security. By taking disability into account, our study demonstrates how these multiple characteristics lead to overlapping oppressions that become embedded and reproduced within the larger social structure. Traditional approaches to measurement of violations of academic integrity may overestimate the magnitude and severity of cheating and confound panic with planned cheating. Differences in the severity and level of premeditation of academic integrity violations have largely been unexamined. Results of a study based on a combined sample of business students showed that students are more likely to commit minor cheating offenses and engage in panic-based cheating as compared to serious and planned cheating offenses. Results also indicated there is a (...) significant interaction between severity and type of cheating. We hypothesized serious and planned cheating offenses would be related to justifications and found the largest differences were between panic and planned. Finally, panic and minor cheating were associated with two self-control-related personality traits. Implications for cheating research are discussed. (shrink)

Business ethics have become an important topic globally for both policy-makers and businesses. This paper first discusses the conceptual framework for business ethics followed by ethical management and corporate social responsibility as well as relevant theories. Within this conceptual framework, Korea is used as a country context as to the development of EM and CSR. An important example of an ethical scandal is the major steel manufacturer, POSCO as it was held up as an exemplar and role model of ethical (...) management. However, in 2015, it faced allegations that the engineering and construction overseas unit chief of its Vietnamese subsidiary created a slush fund by overstating payments to Vietnamese contractors. This conceptual paper discusses the factors that created this situation referring to the theory of connection. It locates the case in the EM and CSR literature and analyses what went wrong and what the parent company could have done to prevent this from happening. (shrink)

Tarski’s Convention T is often taken to claim that it is both sufficient and necessary for adequacy in a definition of truth that it imply instances of the T-schema where the embedded sentence translates the mentioned sentence. However, arguments against the necessity claim have recently appeared, and, furthermore, the necessity claim is actually not required for the indefinability results for which Tarski is justly famous; indeed, Tarski’s own presentation of the results in the later Undecidable Theories makes no mention of (...) an assumption to the effect that the definition of truth implies the biconditionals. This raises a question: was Tarski in fact committed to the necessity claim in the important papers of the 1930s and 40s? I argue that he was not. The discussion of this apparently esoteric interpretive issue in fact gets to the heart of many important questions about truth, and in the final sections of the paper I discuss the importance of the T-biconditionals in the theory of meaning and the relation of deflationary and inflationary theories of truth to the semantic paradoxes. This essay examines the possible systematic bias against the disabled in the structure and practice of genetic counseling. Finding that the profession's “nondirective” imperative remains problematic, the authors recommend that methodology developed by feminist standpoint epistemology be used to incorporate the perspective of disabled individuals in genetic counselors' education and practice, thereby reforming society's view of the disabled and preventing possible negative effects of genetic counseling on the self-concept and material circumstance of disabled individuals.

A striking and unexplained feature of granulomatous inflammation is its anatomical association with the lymphatic system. Accumulating evidence suggests that lymphatic tracks and granulomas may alter the function of each other. The formation of new lymphatics, or lymphangiogenesis, is an adaptive response to tumor formation, infection, and wound healing. Granulomas also may induce lymphangiogenesis which, through a variety of mechanisms, could contribute to disease outcomes in tuberculosis and sarcoidosis. On the other hand, alterations in lymph node function and lymphatic draining (...) may be primary events which attenuate the risk and severity of granulomatous inflammation. This review begins with an introduction of granulomatous inflammation and the lymphatic system. A role of the lymphatic system in tuberculosis and sarcoidosis is then hypothesized. With a focus on lymphangiogenesis in these diseases, and on the potential for this process to promote dissemination, parallels are established with the well‐established role of lymphangiogenesis in tumor biology. This article explores the ways in which language users make sense of metaphoricity when manifest in a variety of ways within the language. The research provides an analysis of the lexical characteristics of a single item when used in potentially, but not clearly identified, metaphoric contexts. The analysis focuses on flexible patterns of meaning and the relationship between metaphor and other aspects of figurative language such as polysemy, metonymy, and meronymy. The research stands as a follow up to a larger (...) corpus-driven study that found differences in the lexical behavior of clearly defined metaphoric and nonmetaphoric instances of items, when looking at a large set of collocations, colligations, and semantic, pragmatic and textual associations. These behaviors or patterns are consequently avoided by the non-metaphoric instances of that same item, in order to avoid ambiguity. In the case of more ambiguous or unclear cases of metaphor, this article aims to determine if these patterns are still visible and the extent to which they signal metaphoricity. Evidence of such patterns would imply that lexical, grammatical, textual, and pragmatic manifestations in language play an important role in distinguishing between subtleties in word senses and meanings, even in the case of less obvious metaphoricity. As a consequence, awareness of these behaviors or characteristics should be at the forefront of any lexical metaphor theory. (shrink)

A central component of ordinary thought about language is that things like English, Japanese and so on exist and that expressions of these languages mean things in them. A familiar philosophical take on this is that communication between speakers is something that happens in such languages and that happens because expressions have meanings in them: one communicates by means of English sentences because these sentences mean something in English. Opposed to this sort of philosophical common sense are two closely related (...) lines of thought. The first, commonly associated with Chomsky (e.g. 1986) and with Weinrich’s famous quote that “a language is a dialect with an army and a navy” is that natural languages are too poorly individuated to do the explanatory work the “commonsense” view requires of them, and are certainly too poorly individuated for serious study of language, or of its role in communication and behavior. For serious purposes, something better defined is required. This first thought leads directly into the second, on which any notion of a language suited for serious study should also bear a closer relationship to the attitudes and abilities of the individual speaker then a nebulous construct such as English could. If whatever meaning an uttered sentence has is determined by relatively “local” facts about the speaker, her intentions and beliefs, and the context of the utterance, language promises to be more closely tied to the speaker, and, one might think, better individuated for it. A move to treating the speaker’s idiolect (or even the idiolect at a time relative to conversational partner) as basic for the study of language is thus motivated both by both individuative and explanatory demands on the notion of a language. On this view, commonly associated in one way with Grice (e.g. 1989) and in another with Davidson (e.g. 2005), but shared by many others, shared languages are simply irrelevant to the determination of meaning, ordinary and philosophical prejudice to the contrary notwithstanding. I find the argument that shared language is irrelevant to the determination of meaning most persuasive in the following form.. (shrink)

Just War Thinking reconsiders the intersection between morality and pragmatics in foreign policy and modern warfare. The book argues that a political ethic of responsibility should motivate the contemporary application of military force by states in order to protect international security and human life, considering the challenges posed by today's new wars: targeted killing, humanitarian intervention, terrorism, jus post bellum, and the influences of public opinion and supranational institutions.

John Hyman makes a good case for the proposition that duress defeases what would otherwise be a voluntary act. In this article, I consider Hyman's arguments in the context of economic duress and conclude that while Hyman makes an excellent case for the proposition that duress vitiates voluntariness, there may be cases where the law might not want to allow the defence of duress.
